1. Who we are

The Website www.psious.com (hereinafter, the “Website”) is operated by and on behalf of Psico Smart Apps, S.L. (hereinafter, “Psious” or the “Company”), a company duly incorporated and existing under the laws of Spain and filed with the Companies Registry of Barcelona, at volume 43.916, page 29, sheet B-441.774, and with registered office in calle Cartagena 187, entresuelo 9, 08013, Barcelona (Spain).


2. Authorised use

These General Conditions of Use (hereinafter, the “General Conditions”) regulate the use of the information society services that Psious makes available to internet users through its Website.

By accessing the Website, you agree to be bound by these General Conditions of Use, as well as the Privacy Policy available on this Website, which may be accessed through this link: Private Policy. Thus, the User is authorised to use this Website solely in accordance with these General Conditions, as well as with the instructions, recommendations or Particular Conditions indicated by Psious at any time. In this regard, we inform the user that some services rendered through the Website may be subject to Particular Conditions which may complement and/or replace the content of these General Conditions, and that will need to be accepted by the User before starting the rendering of the relevant service.

The access to this Website is free, with exception of that relating to the cost of connection through the telecommunications net provided by the service provider contracted by the User.

Psious may at any time and without prior notice vary the content of the Website, including the content of these General Conditions, the particular conditions and the privacy policy. For this reason we recommend the reading of them prior to any access or browsing through the Website. Despite the above, if the General Conditions are modified, the User will be notified.

The User undertakes not to use the Website for fraudulent purposes as well as behave in a way that may be harmful for Psious’ and third parties image, interests and rights. Likewise, the User undertakes to refrain the performance of any act, that could damage, render useless or overload the Website, or that prevents in any manner, the normal use of the same.

In case the user violates these General Conditions or Psious has reasonable grounds to suspect that they are being violated, Psious shall have the right to limit, suspend or terminate the access to the Website by adopting any technical measure that may be necessary to this aim. Psious reserves the right to continue or not the rendering of its services through the Website.


3. Limitation of liability

The user recognizes and accepts that the use of the Website is carried out at user’s own risk and responsibility, so Psious shall not be responsible for the improper or undue use of the Website.

The user recognizes and accepts that, even though Psious makes its best efforts to ensure the technical and factual accuracy of the contents and information contained on the Website, those are purely general and indicative. Thus, the Company cannot guarantee the veracity, authenticity, adequacy or accuracy of the information provided through the Website. As a result, Psious shall not be responsible for the decisions taken by the user drawn from the premise of the information provided through the Website, nor for the damages suffered by the user or a third party, arising from actions based on information obtained on the Website.

Psious shall only be responsible for the damages suffered by the user as a result of the use of the Website when these damages are caused as a consequence of a Psious’ willful misconduct. Psious shall not be responsible, including but not limited to, for the damages arising from (i) interruptions, computer viruses, failures, interferences, or omissions or disconnections of the electronic system, the communications system or the user’s computer equipment for reasons beyond Psious’ control; (ii) delays or saturations in the use of the Website caused by deficiencies or overloads on the telephone lines or the internet system, or in any other electronic or communications systems; or (iii) unlawful actions of third parties beyond Psious’ control.


4. Intellectual and industrial Property

All intellectual and industrial property rights (including the sui generis rights awarded to databases) regarding the content of the Website, graphic design, source code, as well as regarding elements included on it belong to Psious (it includes but is not limited to: text, graphics, logos, distinguishing signs, icons, buttons, photos, videos, audio recording, etc.).

The use of the Website by the user does not imply the assignment of any intellectual or industrial property right of the Website and/or its contents. To these effects, and according to these General Conditions, it is strictly forbidden to carry out any reproduction, transformation, distribution, public communication, making available, extracting and/or re-using of the Website and/or any of its contents, except for those cases permitted by Law.


5. Links

In order to help you finding additional information, we have included several technical linking devices that allow the user to access other websites (hereinafter, “Linked Sites”). In these cases, Psious acts as provider of intermediation services, in accordance with article 17 of Spanish Law 34/2002, of July 12, that regulates the Information Society Services and Electronic Commerce Services.

The existence of links on the website does not mean that Psious is aware of the content and services of those pages nor that Psious maintains a relationship with the owners of the Linked Sites. The existence of such links does not imply the recommendation, promotion, identification or accordance with the contents or services of such websites by Psious. As a result, Psious will not be responsible of the content, the general conditions nor the privacy policies of the Linked Sites, as the user is the sole responsible to accept and verify them every time he access those websites.

The user and, any moral or legal person wishing to establish a link from his website to the Website, shall obtain the prior written authorization of Psious. The establishment of such link does not mean the existence of any relationship between Psious and owner of the linked site, nor the acceptance or approval by the Company of its contents and services.

Notwithstanding the above, Psious unilaterally reserves the right to prohibit or render useless the access to any link at any time particularly if the activity or the content of the linked websites is illegal.


6. Generalities

The use of this Website is construed and governed in accordance with Spanish Law. By accessing this Website you agree that any dispute arising between you and us will be resolved by the Spanish courts, to the extent that the User has his domicile in such country.

If any provision of these General Conditions is declared void, they will be replaced or withdrawn. Such declaration of invalidity shall not affect the rest of the provisions of these General Conditions.
